Fitness For Duty -- Drug Free Work Place Policy

PROHIBITED SUBSTANCES -- DRUG FREE WORK PLACE:
A. The presence of any detectable amount of a prohibited
substance in the employee's system while at work, while on the premises of the
department, or Oronoko Charter Township property, or
while conducting or performing department business is prohibited. Prohibited
substances included illegal drugs, anabolic steroids, alcohol, marijuana, medical
marijuana or prescription drugs not taken in accordance with the a prescription
given to the employee, or those that contain controlled substances as outlined
in other sections of this policy.
B. Marijuana remains an illegal controlled substance in the
State of Michigan and by Federal Statute. As such, no member of the department,
qualified or not by the Michigan Medical Marijuana Act, shall be considered
"fit for duty" regardless of their position if they are using,
smoking or ingesting marijuana for medical purposes. Any member of the
department that has marijuana, THC, or any other compound in their body or
blood from using or ingesting marijuana, shall be considered "unfit for
duty" and as such shall not be permitted to work or perform any job function.
1. Any employee or volunteer of the department that has
applied for, intends to apply for, received, or been
denied a card as a "qualifying patient" under the Michigan Medical
Marijuana Act, shall immediately notify the Chief of Police of any such action
in writing.
2. Any employee or volunteer of the department that has
applied for, intends to apply for, received, or been
denied a card as a "caregiver" under the Michigan Medical Marijuana
Act, shall immediately notify the Chief of Police of any such action in
writing.
3. Any employee or volunteer of the department that has
any person living within their residence or in any property they own, manage or
are under the control of that is considered under the Michigan Medical
Marijuana Act to be a "qualified patient" or "caregiver"
shall immediately notify the Chief of Police in writing indicating the persons
name, the location in question and what relationship the department member has
with the person(s) and/or location.
4. No member of the department shall be permitted to own,
operate, manage, be financially involved in, or be otherwise involved in the
operation in anyway of any marijuana cooperative, dispensary, business or
location that is used to manufacture, grow, process, use, sell or dispense
marijuana for medical purposes or any location that is involved in the sale /
distribution of any paraphernalia that can be used for any of the above.
5. Any member of the department who shall test positive
for marijuana, or any detectable amount of any prohibited or illegal substance
shall be immediately relieved of duty, surrender any and all department owned
firearms, identification cards, deputy sheriff identification cards and shall
not be permitted to perform any police function or possess any firearm in accordance
with employment as a member of this department until so determined by the Chief
of Police.
6. No member of the department shall be permitted to be a
"caregiver" as defined by the Michigan Medical Marijuana Act and/or
the Michigan Department of Community Health for any person, unless so
authorized in writing by the Chief of Police. Permission maybe granted by the
Chief of Police to allow a member to be a "caregiver" in extreme
circumstances and only for a persons of the department members immediate family
who are residing with the department member.
